Currently, there are 3 types of concealed pistol permits available in South Dakota:
Basic, Gold, and Enhanced.
Basic Permit
Gold Card Permit
Enhanced Card Permit

Effective January 23, 2017, the Bureau of Alcohol, Tobacco and Firearms (ATF) approved the purchase exemption from the Brady Handgun Violence Protection Act for Gold Card Permits and Enhanced Permits issued on or after 1/1/2017. Although our state asked for the purchase exemption for all Enhanced Permits that have been issued, ATF (federal government) only approved the ones issued on or after 1/1/2017. Beginning the first of this year the criteria for the background check changed to include the federal disqualifiers under 18 U.S.C. 922(g) or (n). This is outlined in South Dakota Codified Law 23-7-54. I would refer you to the Firearms Laws Handbook accessible from the left dashboard of this page. Because these requirements were not part of the FBI fingerprint background checks that were completed prior to 1/1/2017, ATF would not approve the purchase exemption for the Enhanced Permits issued prior to that date.
If you have an Enhanced Concealed Carry Permit issued on or after 1/1/2017:
Basic, Gold, and Enhanced.
Basic Permit
- Must pass standard background check
- Duration: 5 years
- Benefits: Concealed Carry within South Dakota and recognition for Concealed Carry within 30 other States
Gold Card Permit
- Fingerprint Background check and authorization to conduct background check
- Periodic NICS background check to ensure continued eligibility
- Duration 5 years
- Renewal - (90 days prior to expiration)
- Benefits: Conceal Carry within South Dakota; Recognition for Concealed Carry within 31 other states (Same as Basic Permit); Additional recognition for concealed carry within 1 more state (WI); Purchase exemption as approved by ATF
Enhanced Card Permit
- Requires successful completion of a qualifying handgun course, which includes use of force training, basic concepts, self-defense principles, and live fire training of at least 98 rounds (Cost of training not to exceed $150)

- Fingerprint background check and authorization to conduct fingerprint background check
- Valid in 36 states, including Nebraska and Minnesota
- Periodic NICS background check to ensure continued eligibility for permits issued on or after 01/01/2017
- Duration: 5 year
- Renewal
The holder of an enhanced permit may renew the permit through the sheriff of the county where the holder resides for a period beginning one hundred eighty (180) days before the permit expires and ending thirty (30) days after expiration of the permit. In order to renew an enhanced permit, a person shall (SDCL 23-7-54):- Pass a fingerprint background check and a National Instant Criminal Background Check; and
- Present proof that during the renewal period, the person:
- Successfully completed the live fire component of a qualifying handgun course defined in 23-7-58;
- Received instruction regarding the use of force standards; and
- Received instruction regarding relevant criminal statutory changes.
- If the holder of the enhanced permit to carry a concealed pistol does not renew the permit within thirty (30) days of expiration of the permit, the holder must reapply for an enhanced permit to carry a concealed pistol as outlined in SDCL 23-7-53 (SDCL 23-7-56).
The holder of a gold card permit may renew the permit within ninety (90) days of expiration (SDCL 23-7-62), and a holder of a regular permit may renew ninety (90) days prior to expiration (23-7-8.11).
As per SDCL 23-7-8.13, individuals possessing a permit issued in accordance with chapter 23-7 have a thirty (30) day grace period to renew the permit. During the grace period the permit holder may continue to carry a concealed pistol without violating SDCL 22-14-9. This grace period does not apply to any permit holder who commits a crime that would make it unlawful for the permit holder to possess a gun, or a permit holder who attempted to renew the holder's permit, but was denied (23-7-8.14).
- Benefits: Concealed Carry within South Dakota; Recognition for Concealed Carry within 31 other States (same as Basic Permit); Additional recognition for Concealed Carry within 6 additional States (including Minnesota and Nebraska); Purchase exemption as approved by ATF for permits issued on or after 01/01/2017.

- Legislation has been signed into law by the Governor, which allows you to update the issue date of your Enhanced Permit.
- If you wish to obtain the purchase exemption recognition, contact your county sheriff and request a second fingerprint background check.
- Upon approval, the sheriff will request the Secretary of State’s office to reissue your Enhanced Permit with a current issue date. The expiration date will be changed to five years from the new issue date. There is no additional fee.
- A card with the new issue and expiration dates will be forwarded to you by the Secretary of State's Office. This card will then be recognized for the purchase exemption.
ACTIVE DUTY MILITARY APPLICATION TO RENEW REGULAR PERMITS
On July 1st, 2017, HB 1127 went into effect, which allows active duty military members deployed or assigned outside of South Dakota the ability to complete an application for renewing regular permits only.
This form is to be attested to by the military member’s unit commander or commissioned officer. The form also denotes that the application must be accompanied by documentation of the deployment, including dates and location if available for disclosure and a copy of a current, valid government issued identification card with a photograph.
This application and the original signature serves as the original signature for the temporary permit. Once the application is received by our office, the normal background checks are completed. If approved, a temporary permit will be mailed to the address listed on the application.
It should be noted this process is for renewing regular permits only.

Concealed Permits are only processed by the Office Administrator during regular business hours of 8-5pm Monday thru Friday. Should you wish to apply for a concealed permit outside of regular business hours, you will need to fill out an application (link below) and return it to the Sheriff's Office by mail or by bringing the application into our office. You may also stop in to the Day County Sheriff's Office to pick up an application.
A temporary permit to carry a concealed pistol shall be issued within five days of application to a person if the applicant:
A Concealed Weapon Permit is valid throughout South Dakota except in any licensed on-sale malt beverage or alcoholic beverage or alcoholic beverage establishment that derives over one-half of its total income from the sale of malt or alcoholic beverages (SDCL 23-7-8.1); any county court house as defined in SDCL 22-14-22; or any elementary or secondary schools (SDCL 13-27-7). The permit is also valid in states in which South Dakota has reciprocity agreements (SDCL 23-7-7.3). The permit is not transferable from one person to another (SDCL 23-7-8.3).
A temporary permit to carry a concealed pistol shall be issued within five days of application to a person if the applicant:
- Is eighteen years of age or older
- Has never pled guilty to, nolo contendre to, or been convicted of a felony or crime of violence. (A person who has pled guilty to a felony and received a Suspended Imposition of Sentence is not eligible for a Concealed Pistol Permit.)
- Is not habitually in an intoxicated or drugged condition.
- Has no history of violence.
- Has not been found in the previous ten years to be a "danger to others or a "danger to self" as defined in SDCL 27A-1-1 or is not currently adjudged mentally incompetent.
- Has been a resident of the county where the application is being made for at least thirty days.
- Has had no violations of Chapter 23-7 (firearms control) 22-14 (unlawful use of weapons) or 22-42 (controlled substances and marijuana) constituting a felony or misdemeanor in the five years preceding the date of application or is not currently charged under indictment or information for such an offense.
- Is a citizen or a legal resident of the United States.
- Is not a fugitive from justice.
