Civil Process Information
The Day County Sheriff's Office is responsible for the service of all civil and criminal documents, as well as warrants. The most common documents served by the Day County Sheriff's Office are Summons & Complaints, Garnishee Summons, Affidavits, Notices, Notice to Quit and Vacate, Protection Orders. Motions, Distress Warrants, and Executions. We also serve Subpoenas for civil and criminal cases. Legal documents received from the Courts, attorneys, and private citizens are also among the legal documents that we serve. All Civil Process papers are to be served as quickly as possible with due diligence and an aggressive effort to see that the papers are served.
Fees are charged for Civil process by State Statute SDCL 7-12-18.

* Order of Arrest $25.00
* Summons, Complaint, Warrant of Attachment, Affidavit, $50.00 + mileage
Garnishee Summons, Notice, Claim & Deliver, Injunction, and
Order to Show Cause served on same person
* Summons, Complaint, Warrant of Attachment, Affidavit, $10.00
Notice, Claim & Deliver, Injunction, and Order to Show Cause
served on second person.
* Subpoena & Subpoena for witness $20.00 + mileage
* Serving writ of Execution (satisfied or unsatisfied) $95.00
* Levying Writ of Possession $50.00 + mileage
** if sale of property is not held, actual expenses/costs shall be paid
* Advertisement of sale $25.00 + printing cost
* Posting notice of sale of real property $25.00 + mileage
* Executing Writ or Order of Partition $25.00 + mileage
* Making deeds for land sold on execution or order sale $100.00
(Except no fee is charged when deed only requires Sheriff's signature)
* Mileage $0.59/mile
*NOTE* Pre-payments will not be accepted unless pre-approved with the office Administrator.
